General Terms and Conditions of Sale
These general terms and conditions of sale (“GTC”) govern all sales concluded between:
– BOULANGERIE DU VIAUR, a single-member limited liability company (SARL U) with a capital of €1,300, registered with the Albi Trade and Companies Register under number 980 737 399, headquartered at 14 Bis Place du Foirail, 81190 Mirandol-Bourgnounac, represented by its manager, Mr. Aurélien LANET, hereinafter referred to as “the Seller”,
and
– Any person placing an order on the website https://boulangerieduviaur.fr of Boulangerie du Viaur, hereinafter referred to as “the Customer.”

Preamble
The Seller and the Customer agree that their relationship is governed exclusively by these GTCs as displayed on the website https://boulangerieduviaur.fr at the time of the order.
The Seller offers on the Site bakery, pastry, fine grocery products, and beverages for takeaway orders. No delivery is offered; all products must be collected at the indicated pickup point and time slot chosen during ordering.
All products offered are listed on the Site, accessible 24/7 except during maintenance.
The Seller reserves the right to modify these GTCs at any time, partially or totally.
Article 1: Purpose
The GTCs describe the terms of distance sales of goods between the Seller and the Customer and express all rights and obligations of the Parties. They apply without restriction to all products offered on the Site.
In case of conflict between the GTC and any other document on the Site, the GTC prevail. If any clause is declared null, it does not affect the validity of other clauses.
Article 2: General Provisions
2.1 Full legal capacity of the Customer
The Customer declares to be of legal age (18 years or older) or have authorization from a legal representative and places orders for household needs.
2.2 Scope, enforceability, and duration
The Customer acknowledges having read and accepted the GTCs without reservation. The applicable GTCs are those in effect on the order date.
2.3 Proof
Automatic records of the Seller are considered proof of the nature, content, and date of the contract.
2.4 Modification of GTC
The Seller may adapt or modify the GTCs. Each order remains governed by the GTCs valid on the order date.
Article 3: Product Characteristics and Prices
3.1 Product characteristics
Essential product features are available on the Site. The Customer acknowledges having reviewed them before ordering.
3.2 Availability / Offer validity
Product offers and prices are valid while visible and available. Adding products to the cart does not constitute order validation.
3.3 Subscriptions
If applicable, subscriptions can be taken under terms specified on the Site (duration, pickup day, location).
3.4 Prices
Prices are shown in euros including VAT. The invoiced price is that displayed at order confirmation. Products remain the Seller’s property until full payment.
Article 4: Order
4.1 Customer validation
The Customer validates the order after summary by clicking “Proceed to payment.” Any non-validated order is not honored.
4.2 Seller confirmation
The Seller confirms the order by email and reserves the right to refuse or cancel any order in case of dispute or non-payment.
Article 5: Payment
5.1 Credit card
The Seller accepts CB, Visa, and MasterCard. Payment is due immediately.
5.2 PayPal
The Customer can pay via PayPal; PayPal terms apply.
5.3 Non-payment
Any unpaid or uncollected order may be canceled by the Seller.
5.4 Payment security
Transactions are secured via Shopify gateway or equivalent. Bank data are not stored by the Seller.
Article 6: Retention of Title and Transfer of Risks
Products remain the Seller’s property until full payment. Risks transfer to the Customer upon pickup.
Article 7: Product Pickup
7.1 No delivery
No delivery or postal shipping is offered. Products must be collected by the Customer.
7.2 Pickup location and hours
Pickup at the workshop:
14 Bis Place du Foirail, 81190 Mirandol-Bourgnounac
Tuesday to Saturday: 7:30 AM – 12:30 PM and 3 PM – 7 PM
Sunday: 7:30 AM – 12:30 PM
(subject to changes indicated on the Site)
7.3 Pickup procedure
The Customer presents the order number (or name and email). The order must be checked on site; any complaint must be made immediately.
7.4 Transfer of risks
Risks (temperature, preservation) transfer to the Customer upon handover.
7.5 Non-contractual photographs
Product images on the Site are indicative; slight shape or decoration variations do not justify refusal to pick up.
Article 8: Right of Withdrawal
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal is excluded for perishable goods.
Article 8 bis: Refund & Return Policy
8 bis-1 No right of withdrawal
Per Article L.221-28 1° of the Consumer Code, the right of withdrawal does not apply to perishable goods produced by the Seller.
8 bis-2 Cancellation of “Click & Collect” orders

Until 4 PM the day before pickup: free cancellation by phone or email; full refund by original payment method or, at Customer’s choice, credit valid for 6 months.

After 4 PM or no-show: no refund as products are already in production.
8 bis-3 Refund terms

Maximum delay: 7 business days after agreement.

Refund via the original payment method unless otherwise agreed (credit, cash at counter).

Banking fees (3-D Secure, commissions) are not reimbursed.
Article 9: Guarantees
9.1 Legal warranty of conformity and hidden defects
The Customer benefits from legal guarantees under articles L.217-4 and following of the Consumer Code and 1641 and following of the Civil Code.

Article 11: Use of Personal Data
The Seller collects and processes Customer data for contract execution, order management, and, with consent, sending commercial offers. These are based on Article 6 b) or a) of GDPR.
The Customer has rights of access, rectification, deletion, opposition, limitation, and portability, exercisable by email to boulangerieduviaur@gmail.com.
Complaints can be made to CNIL.
Article 12: Liability
The Seller is only obliged to use best efforts for Site operation.
It is not liable for (i) failure or poor performance due to the Customer, a third party, or force majeure, nor (ii) indirect damages.
In all cases, total indemnification is limited to the amount of the disputed order.
Article 13: Force Majeure
No Party is liable for non-performance due to force majeure (strikes, fire, natural disaster, health crisis, etc.). Obligations are suspended during the event.
Article 14: Applicable Law / Complaints, Mediation, Disputes
GTCs are governed by French law.
In case of difficulty, the Customer should first contact Customer Service for amicable resolution.

Failing amicable solution, courts designated by the Code of Civil Procedure (Albi courts for professionals) are competent.
Article 15: Intellectual Property
All Site elements (texts, images, logos, recipes, graphic charter) are the exclusive property of the Seller or partners.
Any total or partial reproduction without express authorization is prohibited and constitutes infringement under articles L.335-2 and following of the Intellectual Property Code.
